This Privacy Policy explains how Prospera Global Ltd. (the “Company”, “we” or “us”) collects, stores and uses information about you that can identify you. The Company is committed to using your personal information in a lawful and fair manner, and in compliance with the Bermuda’s Personal Information Protection Act 2016 (“PIPA”).This Privacy Policy is designed to comply with our privacy notice requirements pursuant to PIPA

1. What personal information we collect from you

1.1. We collect, use, and disclose personal information and sensitive personal information (as defined in PIPA) about you only for the purposes for which it was collected. We do not sell your personal information or use it for marketing purposes.

The information we need may include:

  • a) contact information such as your name, mailing address, email, phone number;
  • b) demographic information such as your age, gender, date of birth, employment details, marital status, beneficiary information, nationality as well as details related to your beneficiaries or dependents;
  • c) financial information such as contributions, investment funds and accounts, retirement goals, source of income, risk tolerance;
  • d) identifiers such as bank account number and government issued IDs; and
  • e) supporting documents such as tax slips, bank statements and identity verification;

3. How we use your personal information

3.1. Your personal information may be used by us for the following purposes:

  • a) providing you with our products or services and related correspondence;
  • b) processing payments or refunds;
  • c) promoting our products or services (through the use of photographs, videos, brochures or other publications) to you;
  • d) sending you technical notices, updates, security alerts, and support and administrative messages;
  • e) coordinating the provision of our products or services with service providers;
  • f) as may be required for any legal or regulatory purposes associated with our due diligence Anti-Money Laundering and Anti-Terrorism Financing, or other "Know Your Customer" requirements or governance practices;
  • g) trust management and corporate administration;
  • h) communication and relationship management;
  • i) allowing third-party service providers to access or process your personal data and information solely for the purpose of providing specific services for us. We do not permit our third-party service providers to use the personal data and information that we share with them for their marketing purposes or for any purpose other than in connection with the services they provide to us for undertaking data analytics, statistical analysis or related customer relationship assessment and evaluation; and
  • j) managing risk, or detecting, preventing, and/or remediating fraud or other potentially prohibited or illegal activities and crimes.

4. The identity and types of individuals or organizations to whom personal information might be disclosed

4.1. The Company will, or may, disclose your personal information to certain individuals and organizations.

The types of individuals or organizations that may be provided with your personal information are as follows:

  • a) governments, regulatory authorities, public bodies, taxation authorities;
  • b) suppliers, service providers, advisors, consultants;
  • c) affiliates, parent entities and subsidiaries;
  • d) professional advisors, such as legal, accounting, financial or business advisors;
  • e) agents, representatives, authorised business associates or partners;
  • f) marketing or advertising advisers, service providers, website hosts, consultants, agencies;
  • g) third-party outsourcing, cloud, SaaS, DaaS or other IT/data processing service providers; and
  • h) industry consultants, including risk analytics, actuarial, pricing, KYC/due diligence service providers and police organisations.

5. Means we use to allow you to control our use of your personal information in accordance with PIPA

5.1. To obtain access to, or make a request for a correction to, your personal information, please submit a written request to the Privacy Officer, which must include sufficient information to enable us, with reasonable effort, to identify the personal information that is relevant to your request. Your request must also include all necessary contact information for us to respond to your request. You will be contacted by one of our privacy administrators promptly to confirm our receipt of your request, and we will respond to you in no more than two business days after we have received your request. The Company reserves the right to update this Privacy Policy at any time and as may be prudent or necessary to reflect changes in our privacy practices or legal requirements.

Please note the following information associated with any request we receive from you:

  • a) we require your accurate and complete name and contact information;
  • b) we will confirm our receipt of your enquiry or instructions within 48 hours after we have received it; and
  • c) we will take a reasonable amount of time to process your enquiry or instructions and initially respond to your request, but usually no more than 45 days (depending upon the nature and complexity of your request).

The Company reserves all of its rights and protections afforded to it under PIPA.
